Terms of Service

These Terms of Service (“Terms”) govern your access to and use of mysphurit (“the Service”). By creating an account or using the Service, you agree to these Terms.
1. Accounts
- You must be authorised to bind the company on whose behalf you sign up.
- You are responsible for all activity under your account, including any colleagues you invite.
- You must keep your credentials secure and enable two-factor authentication where offered.
2. Subscription & billing
- The Service is offered on monthly or yearly subscription plans whose scope is displayed on the pricing page.
- Plans carry usage limits (users, storage, invoices per month, annual turnover, etc.). Exceeding a limit may block further creation until you upgrade.
- A 14-day free trial is offered on standard plans; no payment is taken during the trial.
- Paid subscriptions auto-renew at the then-current price unless cancelled before the next billing date.
- Fees are in Indian Rupees (INR) and exclusive of 18% GST unless stated otherwise.
3. Acceptable use
You agree not to:
- Upload unlawful, infringing, malicious, or false content.
- Reverse-engineer or copy the Service.
- Probe, scan, or test the vulnerability of the Service without written permission.
- Send spam or unsolicited commercial messages through our integrations.
- Resell the Service to third parties without a commercial agreement.
4. Your content
You retain all rights to business data you enter into the Service. You grant us a limited licence to host, display, back up, and transmit this data only as necessary to provide the Service to you.
On cancellation you may export your data. After the retention window expires, we will irreversibly delete it (Indian statutory records are held for the minimum required period).
5. Integrations
Where you connect a third-party service (Google Drive, Meta, MSG91, Razorpay, GSTN), you are bound by that service's terms in addition to ours. We are not responsible for third-party outages, API changes, or policy changes that affect functionality.
6. Cancellation & refunds
You can cancel from Settings → Subscription at any time. Refunds follow our Refund & Cancellation Policy.
7. Service levels
- We target 99.9% monthly uptime for core platform services.
- Planned maintenance is announced at least 24 hours in advance.
- Uptime excludes force majeure, third-party outages, and customer-caused incidents.
8. Warranties & liability
The Service is provided “as is”. To the maximum extent permitted by law, our aggregate liability for any claim relating to the Service is limited to the subscription fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential losses (including loss of revenue, profits, or data).
9. Suspension & termination
- We may suspend or terminate access for non-payment, breach of these Terms, or regulatory reasons.
- You can terminate at any time; terminations take effect at the end of the current billing period.
10. Changes to these Terms
We will notify you of material changes at least 30 days in advance via email and in-app banner. Continued use after the effective date constitutes acceptance.
11. Governing law
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.
